  • Tuesday 01/22/2019: January Jacksonville City Council Meeting

Attention all Article6 Northeast Florida members,

Please try to join us in making the Jacksonville City Council January 22nd, 2019.

The vast majority of this meeting will be routine and extremely boring city council business. However, special interest groups such as "Mom's Demand Action for Gun Sense in America" / "Everytown for Gun Safety" have been showing up and pressuring (emotional pleas, not common sense or lawful) during the public comments section of the meeting. It is important that we show up and represent the rule of Constitutional law and natural rights to self-defense.

Here is the link to the "Moms Demand Action" call to action for this meeting: https://act.everytown.org/event/moms-demand-action-event/16703/

The content from their event page states:

"We need you to come to City Hall for the public speaking section of the meeting. We will all meet at 5;30 pm in the rotunda, fill out the blue cards with your information, in the comment section write "Close the Gun Show Loophole", and then you either mark speak or do not speak. Anyone not speaking will have their card read at the end and put in to the public record. Please wear a red."

Some sections of law to consider focusing on:

    A) Second Amendment: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." It does not say "the right of the Militia", it says "the right of THE PEOPLE".

    B) Article VI (6), United States Constitution (relevant portion): "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."

    C) Florida Statute 790.33: Field of regulation of firearms and ammunition preempted. "(1) PREEMPTION.—Except as expressly provided by the State Constitution or general law, the Legislature hereby declares that it is occupying the whole field of regulation of firearms and ammunition, including the purchase, sale, transfer, taxation, manufacture, ownership, possession, storage, and transportation thereof, to the exclusion of all existing and future county, city, town, or municipal ordinances or any administrative regulations or rules adopted by local or state government relating thereto. Any such existing ordinances, rules, or regulations are hereby declared null and void.".

    D) 18 U.S. Code § 241: Conspiracy against rights. "If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured— They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death."

You are welcome to speak. If you do, please keep it calm, professional, factual, short and well thought out. Optics matter! The last thing we want is to give the progressive/communists ammunition to say "see, these bunch of unhinged raised by wild boar rednecks...".

There is a 3 minute limit on your presentation. Let's not lose them on endless statistics. Let's try to keep it law, common sense and use their anti-American tactics of emotion against them.

I do find it of particular interest in 18 U.S. Code § 241 that "...and if death results from the acts committed in violation of this section... they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death". Not my opinion, it's what the actual law states. Perhaps criminal charges should begin to be file whenever and every time a death occurs to a person who has been unlawfully stripped / limited in their Constitutionally protected "shall not be infringed" "supreme law of the land" rights.

Let us not assume that any member of the Jacksonville City Council is for unlawful gun control unless they prove to us otherwise. It is unseemly and unprofessional to assume these things and verbally attack them. The rule of law is what matters and holding those who break it or conspire to break it accountable.

You can also fill out a comment card with your views. PAT team lead Kenneth Morrow may be present but has been quite busy in Tallahassee lobbying for various Constitutional issues. Nonetheless, one of our team will be able to answer any questions and give guidance when we are on-scene.

It is strongly suggested that you wear your Article6 shirts and A6 hats! We want to present organization, uniformity and professionalism. The opposition to the rule of law does (same shirts, colors, etc). Other than that, we want to try not to look too tactical during this meeting. Jeans or slacks would be best. Optics and numbers.

People have jobs and will be traveling from various distances, so we very well may not all be able to rally at an exact time. However, for those who can, I suggest rally-point at the garage at 5PM. Feel free to reach out to fellow members in your area to potentially carpool.

Free parking is available the night of the meeting. The garage is at the corner of Duval and Main. After you park there, get a voucher in the lobby of the council chambers between 5:00 PM to 6:00 PM or see a CC staff member if you arrive after that time. If we have enough people and anyone wants to volunteer, it would be nice to have one or two watch the vehicles in the parking garage. We will not announce publicly any of our team members pulling this duty.

In defense of our Constitutional Republic,
Ken R, Northeast Florida Regional Coordinator
